Maryland Looks To Eminent Domain To Save Pimlico

The Maryland Legislature is concerned about the future of Pimlico racetrack, home to the famous Triple Crown horse race. The Legislature's concern stems from the pending bankruptcy of Magna Entertainment Corp., owner of the race track.

The legislature's solution was to craft a bill giving the state the power to condemn the property through eminent domain. This would allow the state to ensure that a future owner does not move the race and tear down the famous race track.

It may well be that much of this fear is premised on lingering bad feelings from the Baltimore Colts midnight departure from Baltimore for Indianapolish in the early 1980s.

Many critics complaint the bill crafted by the legislature was hastily put together and will probably not be effective. In addition, there is the issue as to whether the bankruptcy judge will take the threat of eminent domain into accout when directing the sale of Magna's assets.
